1. Introduction & Acceptance of Terms
Welcome to The Movement Temple. These Terms & Conditions ("Terms") govern your access to and use of our website, mobile and online booking applications, studio facilities, classes, private sessions, workshops, teacher trainings, events, memberships, packages, gift cards, and any related products or services (collectively, the "Services") offered by The Movement Temple ("we," "us," "our," or "the Studio").
By accessing our website, booking or attending a class or session, purchasing a membership, package, or gift card, enrolling in a teacher training or event, or otherwise using our Services, you ("you," "your," "client," or "member") agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
You must be at least 18 years of age to purchase Services or enter into these Terms. If you are under 18, a parent or legal guardian must agree to these Terms on your behalf and accept responsibility for your participation. Certain classes or programs may carry additional age or health requirements.
2. Our Services
The Movement Temple is a holistic movement and wellness studio offering "Movement as Medicine." Our Services include, but are not limited to, group classes (such as Yoga Trapeze, Mat Pilates, Melt fascia release, Sound Baths, and Restorative Yin Trapeze), Trio classes and small-group sessions (including Pilates Reformer and Gyrotonic), private one-on-one and duet sessions, teacher training courses, workshops, special events (such as Full Moon Sound Baths), memberships, class packages, and gift cards.
We reserve the right to modify, add, or discontinue any class, program, service, schedule, instructor assignment, or pricing at any time and without prior notice. Class schedules, instructors, and offerings are subject to change.
3. Booking, Scheduling & Attendance
Booking. Classes, sessions, and events may be booked through our website, our online scheduling system, or our booking application. All bookings are subject to availability. Group classes are limited in capacity (generally a maximum of 20 participants), and space is reserved on a first-come, first-served basis.
Account information. You are responsible for providing accurate and current information when creating an account or booking, and for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.
Late arrival. For the safety of all participants, we ask that you arrive on time. Late arrivals may be denied entry at the instructor's discretion, particularly where a late entry would disrupt the class or compromise participant safety (for example, after a warm-up has been completed). No refund or credit is given for entry denied due to late arrival.
Health and equipment. Certain classes use specialized apparatus and equipment. You agree to follow all instructor guidance, posted studio rules, and safety instructions at all times.
4. Cancellations, Late Cancellations & No-Shows
Class cancellation window. Unless otherwise stated at the time of booking, group classes may be cancelled without penalty up to twelve (12) hours before the scheduled start time. Cancellations made within the cancellation window, or failure to attend ("no-show"), will result in forfeiture of the class credit or a late-cancellation fee, as applicable to your booking or membership type.
Private and small-group sessions. Private, duet, and Trio classes require at least twenty-four (24) hours' notice of cancellation or rescheduling. Sessions cancelled with less notice, or missed, may be charged in full or deducted from your package.
Studio cancellations. We reserve the right to cancel or reschedule a class, session, or event—for example, due to low enrollment, instructor unavailability, facility issues, weather, or other circumstances. If we cancel, you will be offered a credit, rescheduling, or, where required, a refund for that specific booking. We are not responsible for incidental costs (such as travel) associated with a cancelled class or event.
How to cancel. Cancellations must be made through our online booking system or by contacting us directly during business hours. Please note the specific cancellation window shown at checkout, which controls where it differs from the above.
5. Memberships & Class Packages
Memberships. Memberships may be offered on a recurring (auto-renewing) basis. By purchasing a recurring membership, you authorize us (and our third-party payment processor) to automatically charge your payment method on file at the stated interval (e.g., monthly) until the membership is cancelled in accordance with these Terms. Membership pricing, benefits, and terms are those in effect at the time of each renewal.
Auto-renewal and cancellation. Recurring memberships continue until cancelled. Unless otherwise stated for a specific membership, you may cancel by providing notice at least five (5) business days before your next billing date through the method we designate. Cancellation stops future billing; it does not refund charges already incurred or the current billing period. Any minimum commitment term will be disclosed at the time of purchase.
Non-refundable but transferable. Memberships are non-refundable. However, a membership may be transferred to another person, provided you notify us in advance so we can update our records. The recipient of a transferred membership is subject to these Terms and to the membership's original terms, benefits, and remaining duration. Transfers are for the balance of the existing membership and do not extend or renew its term.
Membership freezes/holds. Where offered, memberships may be paused or frozen subject to the conditions stated for that membership (for example, a limited number of freeze days per year, or a small hold fee). Requests must be submitted in advance.
Class packages. Class packages (class "packs") entitle you to a set number of classes or sessions and are valid only for the stated period.
Packages expire on the stated expiration date, after which unused classes are forfeited and are not refundable or transferable, except where required by law. Packages are for the personal use of the purchaser and, unless expressly stated, may not be shared or transferred.
Price changes. We may change membership fees, package prices, and other charges. For recurring memberships, we will provide reasonable advance notice of a price change, and continued use after the change takes effect constitutes acceptance of the new price.
6. Payments
All fees are quoted in U.S. dollars and are due at the time of purchase or, for recurring plans, at each billing cycle. You represent that you are authorized to use the payment method you provide. Payments are processed by third-party payment processors, and your use of those services may be subject to their terms and privacy policies. If a payment fails, we may suspend access to the associated Services and attempt to re-process the charge. You are responsible for any applicable taxes.
7. Gift Cards
Gift cards may be purchased through our website or at the Studio and redeemed toward eligible Services. Unless otherwise stated or required by law: gift cards are non-refundable and may not be redeemed for cash (except where cash redemption is required by applicable law); and any expiration or terms will be disclosed at the time of purchase and applied consistent with New Mexico and federal law. Gift cards are transferable and may be given to or used by another person; the holder of a gift card may redeem it toward eligible Services subject to these Terms. Please treat gift cards like cash, as they cannot be replaced if lost or stolen.
8. Refunds & Exchanges
Except where expressly stated in these Terms or required by applicable law, all sales are final and payments for classes, packages, memberships, private sessions, gift cards, workshops, events, and teacher trainings are non-refundable. Where we offer a remedy, it will generally take the form of studio credit or the option to reschedule rather than a cash refund. Unused classes, expired packages, and missed sessions are not refundable. Refund requests based on exceptional circumstances (such as documented medical reasons) will be considered on a case-by-case basis at our sole discretion, and any approved refund may be subject to a processing fee. Nothing in these Terms limits rights that cannot be waived under applicable law.
9. Teacher Trainings, Workshops & Events
Enrollment and deposits. Teacher training courses (such as Sound Healing, BASI Pilates, and Gyrotonic Pretraining), multi-session workshops, and special events may require a non-refundable deposit and/or full payment to secure your place. Deposits reserve limited capacity and are non-refundable except where expressly stated.
Payment plans. Where a payment plan is offered, you authorize the scheduled installment charges to your payment method. You remain responsible for the full program fee once enrolled, regardless of attendance, unless a written cancellation policy for that program provides otherwise. Missed installments may result in suspension from the program until the balance is brought current.
Cancellation and transfers. Cancellation terms for each training, workshop, or event—including any refund, credit, or transfer eligibility and applicable deadlines—will be provided at the time of enrollment and control over the general refund policy in Section 8 where they differ. If we cancel or substantially reschedule a training or event, we will offer you a credit, a transfer to a future offering, or a refund of amounts paid for that program, at our discretion and consistent with the program terms.
Certification. Completion requirements, certification standards, and any third-party certifying body requirements will be described in the program materials. Purchase or attendance does not guarantee certification; certification is contingent on meeting the stated requirements.
10. Health Disclaimer, Assumption of Risk & Release
Please read this section carefully. It affects your legal rights.
Not medical advice. The Movement Temple provides movement, fitness, and wellness Services. Our Services, including any references to "Movement as Medicine," sound healing, fascia release, or wellness practices, are not a substitute for professional medical advice, diagnosis, or treatment. We are not acting as your physician or licensed medical provider. Always consult a qualified healthcare professional before beginning any exercise program or wellness practice, particularly if you are pregnant, have a medical condition or injury, or have any concerns about your ability to participate.
Fitness to participate. By participating, you represent that you are in good physical condition and have no medical condition, disability, injury, or impairment that would make participation unsafe. You agree to disclose relevant health information when requested and to inform your instructor of any condition, injury, pregnancy, or limitation that may affect your participation. You are responsible for exercising within your own limits and for stopping any activity that causes pain or discomfort.
Assumption of risk. You understand and acknowledge that physical movement, exercise, and the use of apparatus and equipment involve inherent risks. This includes, without limitation, participation in aerial Yoga Trapeze and the use of aerial and trapeze equipment; Gyrotonic equipment and exercise; Pilates, including Mat Pilates and Pilates Reformer equipment; Melt fascia release and the associated rollers, balls, and props; as well as mats, props, and sound instruments. These risks include, without limitation, muscle strains, sprains, fractures, falls, contact with or failure of equipment, aggravation of pre-existing conditions, and, in rare cases, serious injury or death. Sound baths and vibrational practices may not be suitable for everyone, including certain individuals who are pregnant or have specific medical devices or conditions. You voluntarily and knowingly assume all risks associated with your participation in the Services, whether foreseen or unforeseen.
Release and waiver. To the fullest extent permitted by law, you hereby release, waive, and discharge The Movement Temple, its owners, instructors, employees, contractors, and agents from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury (including death) sustained in connection with your participation in the Services, whether caused by ordinary negligence or otherwise, except to the extent such liability cannot be waived under applicable law. This release is intended to be as broad as permitted by the laws of the State of New Mexico and survives termination of these Terms.
Separate waiver. You may be required to sign a separate assumption-of-risk and liability waiver before participating. That waiver supplements, and does not replace, this Section.
11. Studio Rules & Code of Conduct
To keep the Studio safe and welcoming, you agree to: treat instructors, staff, and other participants with respect; follow all posted rules, instructor directions, and safety guidelines; use equipment only as instructed and report any damage or malfunction; arrive in appropriate attire; refrain from disruptive, threatening, harassing, or unsafe behavior; and refrain from attending while ill with a contagious condition. We reserve the right to refuse service, remove any person from the premises, or terminate a membership or enrollment—without refund—for conduct we determine, in our sole discretion, to be unsafe, disruptive, abusive, or in violation of these Terms.
12. Personal Property
You are responsible for your personal belongings. The Movement Temple is not responsible for any lost, stolen, or damaged property brought onto the premises. Please do not bring valuables to the Studio.
13. Photography & Media
We may occasionally photograph or record classes, events, or the Studio for marketing or educational purposes. If you prefer not to be included, please notify us in advance and we will make reasonable efforts to accommodate your request. Any use of your image will be handled consistent with our Privacy Policy.
14. Intellectual Property
All content on our website and in our programs—including text, graphics, logos, the "The Movement Temple" name and marks, images, videos, class formats, training curricula, and materials—is owned by or licensed to The Movement Temple and is protected by intellectual property laws. You may not copy, reproduce, distribute, record, republish, or create derivative works from our content or training materials without our prior written permission. Teacher training and course materials are provided for your personal, non-commercial educational use only.
15. Website Use & Third-Party Services
You agree to use our website and online systems only for lawful purposes and not to interfere with their operation or security. Our booking, scheduling, and payment functions may be provided by third-party platforms; your use of those platforms is also subject to their terms and privacy policies. We are not responsible for the content, availability, or practices of third-party websites or services linked from our own.
16. Privacy
Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our Services, you consent to the practices described in that policy.
17. Limitation of Liability
To the fullest extent permitted by law, in no event shall The Movement Temple or its owners, instructors, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Services, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Services shall not exceed the amount you paid to us for the specific Service giving rise to the claim during the six (6) months preceding the event. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
18. Indemnification
You agree to indemnify and hold harmless The Movement Temple and its owners, instructors, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
19. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to the personal jurisdiction of those courts. Before initiating any formal proceeding, you agree to first contact us in good faith to attempt to resolve the matter informally.
20. Changes to These Terms
We may update or modify these Terms from time to time. The most current version will be posted on our website with an updated "Effective Date." Changes are effective when posted. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
21. Severability & Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. These Terms, together with any policies referenced herein and any program- or purchase-specific terms presented at checkout, constitute the entire agreement between you and The Movement Temple regarding the Services.
